IM=X Pilates and Fitness, the Xercize Studio, LLC, and its subsidiaries (collectively referred to herein as “IM=X,” “we,” “us,” or “our”) recognize that your privacy is very important, and we are committed to protecting any Personal Information we may collect from or about you. “Personal Information” means any information that can, directly or indirectly, be used to identify you. This Privacy Policy explains how IM=X may collect, use, disclose and secure Personal Information that we collect online.

This Privacy Policy does not apply to independently owned and operated franchisees’ collection, use, and disclosure of your information, except as described in this Privacy Policy with regard to certain data sharing practices.

  • Enable our franchisees to provide services to you in their independently owned and operated studios, and to facilitate a franchisee’s transition to a new owner upon leaving our franchise system, including ensuring that the respective studio’s members’ Personal Information is transitioned to the new owner so that members continue to receive services;
  • Develop our franchise program;
  • Enforce our rights arising from any contracts entered into between you and us, including for billing and collection;
  • Protect the rights, property, or safety of IM=X, our customers, or others;
  • Assess your use of our website, measure engagement, conduct data analysis, identify usage trends, and create new or improved services;
  • Carry out any other purpose for which you have otherwise provided your consent; and/or

IM=X’s independently owned and operated franchisees may also send promotional email communications regarding IM=X products, services, or classes. If you receive promotional communications from a franchisee and would like them to stop, you can generally do so by following the directions in the relevant email, however, IM=X is not responsible for the email or marketing practices of its independently owned and operated franchisees.

DATA RETENTION

Generally, we will retain Personal Information for the period necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by applicable law. This may include retaining your Personal Information, even after the completion of our services, in order to provide you with future updates about IM=X, as well as to comply with our legal obligations, resolve disputes, or enforce any of our agreements.

It is important to note that our website contains links to third-party websites, and such third-party websites do not follow the same privacy practices as IM=X. CHILDREN UNDER THE AGE OF 13
